Scope and Permitted Use

This Acceptable Use Policy (“AUP”) applies to every service provided by Serverside Networks Inc. (“Serverside.com”), including dedicated servers, cloud servers, IP transit and related network services, and DDoS protection. Services may be used for any lawful workload, including web applications, databases, storage and backups, game servers, media streaming, machine-learning and other compute workloads, and blockchain nodes, subject to the restrictions in this policy. You are responsible for everything that runs on your service and for everyone you allow to use it. Where this policy refers to “you” or “the customer”, it includes your users, resellers and anyone acting on your behalf.

Illegal Use

Serverside.com services may not be used for illegal purposes, or in support of illegal activities. Serverside.com reserves the right to cooperate with legal authorities and/or injured third parties in the investigation of any suspected crime or civil wrongdoing.

Threats and Harassment

Using Serverside.com services to transmit any material (by e-mail, uploading, posting or otherwise) that threatens or encourages bodily harm or destruction of property, or that harasses another person, is prohibited.

Forgery or Impersonation

Adding, removing or modifying identifying network header information in an effort to deceive or mislead is prohibited. Attempting to impersonate any person by using forged headers or other identifying information is prohibited. The use of anonymous remailers or nicknames does not constitute impersonation.

Fraud

Fraud involves a knowing misrepresentation or misleading statement, writing or activity made with the intent that the person receiving it will act upon it. Using Serverside.com services to make fraudulent offers to sell or buy products, items or services, to advance any type of financial scam such as “pyramid schemes” and “chain letters”, or to host phishing pages or other material designed to obtain credentials or payment details by deception, is strictly prohibited and offenses will be investigated.

Unauthorized Access

Use of Serverside.com services to access, or to attempt to access, the accounts of others, or to penetrate, or attempt to penetrate, security measures of Serverside.com or another entity’s computer software or hardware, electronic communications system, or telecommunications system, whether or not the intrusion results in the corruption or loss of data, is expressly prohibited and the offending Serverside.com account is subject to immediate termination and further investigation.

Security Testing

Vulnerability scanning, penetration testing and similar security research may only be directed at systems you own or are expressly authorized in writing to test. Testing directed at Serverside.com’s infrastructure, or at any third party without such authorization, is treated as unauthorized access.

Network Disruptions and Unfriendly Activity

Use of Serverside.com services for any activity which affects the ability of other people or systems to use Serverside.com services or the Internet is prohibited. This includes “Denial of Service” (DoS) attacks against another network host or individual user, operating or renting out attack tools or “booter” services, and interference with or disruption of other network users, services or equipment. It is the customer’s responsibility to ensure that their systems are configured in a secure manner. A customer may not, through action or inaction, allow others to use their service for illegal or inappropriate actions, and may not permit their service to be configured in such a way that gives a third party the capability to use it in an illegal or inappropriate manner, including open resolvers, open proxies, open mail relays and other services that can be abused for reflection or amplification attacks.

Unsolicited Email

Sending unsolicited bulk or commercial email (“spam”) from, through or in connection with Serverside.com services is prohibited, as is using our services to collect responses to spam sent from elsewhere. Mailing lists must be opt-in and every message must offer a working unsubscribe mechanism. Customers who operate mail servers must comply with applicable anti-spam law and keep their servers from acting as open relays. Serverside.com may block outbound mail ports on a service where abuse is reported.

Prohibited Content

Serverside.com services may not be used to store, distribute or link to: material that is illegal in the jurisdiction where it is hosted or accessed, including child sexual abuse material; pornography; malware, exploits or command-and-control infrastructure; material used for extortion or blackmail; or content that you do not have the right to distribute, including operating a service whose primary purpose is the distribution of copyrighted works without authorization.

Network and IP Address Space

IP addresses assigned to your service remain the property of Serverside.com or its registry and are provided for use with that service only. You may not announce, re-assign, sub-allocate or route Serverside.com address space, or any prefix over a Serverside.com transit or peering session, without prior written authorization. Customers who bring their own address space must hold the right to use it and must keep their registry records (including route and abuse objects) accurate. Traffic with forged source addresses must not be sent from your service. Serverside.com may reclaim address space that is used in breach of this policy, or that is listed on reputation blocklists as a result of the customer’s activity, and may filter announcements to protect the network.

Resource Use on Shared Infrastructure

Cloud servers run on shared hardware. Sustained use of CPU, disk I/O, memory or network capacity that degrades the service for other customers is not permitted on cloud servers, and Serverside.com may throttle or suspend a service that does so after notice. Cryptocurrency mining and similar proof-of-work computation is prohibited on cloud servers; it is permitted on dedicated servers that you rent in full. Blockchain nodes, validators and indexers are permitted on any service.

Third-party Links, Sites and Services

Our products may contain links to third-party websites, advertisers, services, special offers, or other events or activities that are not owned or controlled by Serverside.com. We do not endorse or assume any responsibility for any such third-party sites, information, materials, products, or services. If you access any third-party website, service, or content from Serverside.com, you do so at your own risk and you agree that Serverside.com will have no liability arising from your use of or access to any third-party website, service, or content.

Reporting Abuse

Reports of abuse originating from the Serverside.com network should be sent to [email protected]. Please include the source IP address or hostname, the date and time with time zone, and relevant log excerpts or full message headers. We review every report and forward it to the customer responsible where appropriate; we do not disclose the identity of a customer or a reporter to the other party except as required by law.

Copyright and Takedown Notices

Notices of claimed copyright infringement should be sent to [email protected] and must identify the copyrighted work, the material claimed to be infringing and its location on our network, your contact details, and a statement that you believe in good faith that the use is not authorized. We forward valid notices to the customer and may remove or disable access to the material where the customer does not resolve the complaint. Serverside.com does not review the content of customer servers on its own initiative.

Enforcement

Where Serverside.com believes a customer has breached this policy, it will normally notify the customer and allow a reasonable period to resolve the issue before suspending the service. Serverside.com may suspend or filter a service immediately, without notice, where it is the source of an active attack, where required by law enforcement or a court order, or where continued operation poses an imminent risk to other customers, the network or third parties. Repeated or serious breaches may result in termination of the service without refund, as described in the Terms of Service. A customer who believes a suspension was made in error may respond to the notice or contact [email protected].
